It is not necessary for you to have your attorney attend mediation.  However, if you have an attorney,  it would be advisable that he or she remain available to you via telephone during the mediation session.  That way you are assured of getting the proper legal advice should that be an issue during the mediation.  Some couples are able to resolve their differences without attorneys.  Others are not.  If your attorney attends the mediation session, he or she will be there to assist you in identifying issues for resolution and the legal parameters surrounding those issues.  You would still be the main participant in the mediation process.

Q: Who will prepare the divorce papers?

The goal of mediation is to arrive at written agreements.  Your attorney can prepare the appropriate court pleadings based on the agreement.  Some couples who do not have attorneys take advantage of the Indiana Supreme Court's website which contains form divorce pleadings.  Others may use legal zoom or other internet legal form providers.  As an attorney, I am also able to assist in the preparation of legal forms for filing in court.
